Terms of use
1. General Provisions
1.1. These terms of use govern the use of Jobtero. By downloading or using the app or the platforms, you agree to these terms. These terms of use apply between Jobtero and the users of Jobtero’s websites, applications, or services. For job advertisements, the terms of use do not apply; instead, our General Terms and Conditions do. These terms constitute a binding agreement between users.
1.2. The platforms are provided by Jobtero LLC, headquartered in 39040 Kastelruth (BZ), South Tyrol – Italy, registered in the Bozen Trade Register, number 03143890212, REA BZ – 235815, VAT no. IT03143890212.
1.3. These terms of use may be updated from time to time. You will be informed of significant changes by us posting the new terms on the platforms. By continuing to use the platforms after such a posting, you agree to the revised terms.
1.4. Regarding changes to the subject matter of the contract or essential rights and obligations, Jobtero will inform you of the intended change. The continuation of the contractual relationship remains ensured.
1.5. Jobtero may temporarily or permanently block users’ access to the platforms if they violate these terms.
2. Use of the Platforms
2.1. The platforms may only be used for the purposes specified in these terms and conditions.
2.2. You undertake not to use the platforms for illegal purposes or in any way that could impair the platforms or the use of the platforms by others. It is not permitted to use these services in any other commercial manner.
2.3. The platforms may only be used by individuals who have reached the legal minimum age for entering into legally binding contracts in their country. If you are younger, you need the consent of a parent, legal guardian, or custodian.
2.4. Jobtero does not conduct criminal background checks or identity verification of its users.
2.5. In case of any conflicts between these terms and a contract you have with Jobtero, the contract takes precedence.
3. User Obligations and Responsibilities
3.1. Each user is responsible for their own actions and content. All personal statements do not reflect the opinion of Jobtero.
3.2. By uploading content, you agree to indemnify, defend, and hold us harmless from all claims related to your content. The content included in your individual profile should be relevant to the intended use of our services.
3.3. You may not upload prohibited content. Specifically, the following actions are prohibited:
a. Posting content that is harassing, offensive, threatening, defamatory, obscene, tasteless, hateful, racist, discriminatory, or otherwise illegal, that infringes on the rights of third parties, or is confidential;
b. Posting material that directly or indirectly contains pornographic, explicit, or inappropriate content or links to such content;
c. Harassing another user or the poster of a job advertisement or promoting such harassment;
d. Transmitting, storing, or destroying content on Jobtero platforms in violation of applicable regulations;
e. Impersonating another person, claiming false or misleading information or facts, falsifying usernames;
f. Posting and sharing login credentials or contact information with third parties;
g. Storing, posting, or sending advertising, junk, or mass emails, or other commercial communication;
h. Using techniques or services to falsely display user activities, send messages, post comments, or perform other actions;
i. Endangering or attempting to endanger the security of Jobtero platforms or attempting to disrupt services or networks;
j. Promoting, supporting, or encouraging illegal activities.
3.4. Your individual profile is visible to other people on the internet, so please ensure before posting that you are comfortable sharing your content. You acknowledge and agree that your content may be viewed by other users and that other users may share your content with third parties regardless of these terms of use. By uploading your content, you represent and warrant to us that you have all necessary rights and licenses to do so, and you automatically grant us a license to use your content.
3.5. You agree to indemnify, defend, and hold Jobtero, our affiliates, and their respective employees harmless if a claim, demand, damage, loss, cost, liability, or similar is made against us due to your actions.
4. Obligation to Comply with Legal Provisions
4.1. All users of Jobtero are required to respect and adhere to applicable laws and regulations, especially those related to the protection of children from sexual abuse and exploitation.
4.2. We do not tolerate any content or activities involving or promoting the sexual abuse or endangerment of children. If we become aware of possible exploitation or abuse of children, we will report it to the relevant authorities in compliance with applicable laws.
4.3. Content that depicts, contains, or promotes child pornography, sexual exploitation, or abuse is strictly prohibited.
5. Prohibited Content and Behaviors
5.1. It is strictly forbidden to publish, distribute, share, or store materials that depict or suggest sexual violence or exploitation of children; show children in an inappropriate or exploitative manner or promote targeted approaches to children with abusive intent.
5.2. Attempts to contact children to exploit or sexually abuse them are prohibited and will be prosecuted under criminal law.
5.3. Child labor and any form of work that harms the physical or mental development of children and adolescents, prevents them from attending school, or for which they are too young are prohibited.
6. Obligation to Report
6.1. Users are required to promptly report any content or behavior indicating sexual abuse or exploitation of children. Reporting options are available on our platform.
6.2. Users must ensure that they do not create, share, or store content that violates these conditions.
7. Measures in Case of Violation
7.1. In the event of a violation of these conditions, the platform reserves the right to take the following actions:
7.1.1. We may temporarily suspend users who repeatedly post clearly illegal content after a warning. Additionally, we may permanently terminate their account.
7.1.2. If individuals repeatedly submit abusive reports after a warning, we may suspend the processing of incoming reports for a limited time.
7.1.3. Report the incident to the relevant authorities. To ensure the protection of children, we reserve the right to process user data in accordance with applicable data protection laws in cases of suspected sexual abuse or exploitation.
7.2. Content that violates these conditions will be removed immediately.
8. Registration and User Account
8.1. To use certain features of the platforms, you must create a user account. You must provide your email address and a password, which we memorize. You are responsible for keeping your login details confidential. Once registered, additional information may be indicated to complete your profile.
8.2. To post a job advertisement, you must register the organization after signing up, provide customer data, and a valid payment method. Your data will then be reviewed, and only afterward will the job advertisement be activated on Jobtero’s platforms.
8.3. You are required to provide truthful, accurate, and complete information when registering and to keep this information up to date. If false information is provided, Jobtero has the right to suspend the user account and access to the platforms.
8.4. You may not transfer your user account to third parties or allow third parties access to it. All users may only create one user account, which is non-transferable.
9. Costs and Fees
9.1. The basic version of the platforms may be free of charge. Certain features or content are chargeable.
9.2. All fees are exclusive of applicable taxes.
9.3. The services provided by Jobtero under these terms of use are free of charge.
10. Intellectual Property
10.1. All content and materials on the platforms, including but not limited to texts, graphics, logos, designs, databases, and software, are the property of Jobtero or its licensors and are protected by copyright laws.
10.2. You may use these contents only as part of your use of the platforms and solely for personal, non-commercial purposes. Between you and Jobtero, Jobtero is considered the sole owner of all intellectual property rights.
11. Disclaimer of Liability and Limitation of Liability
11.1. Jobtero’s liability is limited to the minimum permitted by law.
11.2. The platforms are provided “as is” and “as available.” Jobtero makes no warranties regarding the error-free nature, completeness, or availability of the platforms. Potential disruptions, interruptions, or downtimes of the platforms cannot be excluded. Jobtero reserves the right to temporarily or permanently limit the data volume for uploads.
11.3. To the extent permitted by law, Jobtero excludes all liability for direct, indirect, incidental, or consequential damages, including lost profits, arising from the use or inability to use the platforms. Jobtero is not liable under legal provisions in the case of slight negligence.
11.4. Jobtero does not review the content of job advertisements (referred to as “Jobs”), classified advertisements (referred to as “Jobees”), or the profiles offered. Jobtero is not involved in transactions and agreements between connected parties and has no control over them. Jobtero does not guarantee the user content, legality, security, or quality of the published jobs or resumes, nor the truthfulness or accuracy of the offers, the ability of employers, or employees.
11.5. Jobtero is not involved in the communication between users and therefore has no control over the accuracy, completeness, and timeliness of profiles and user content. Users bear all risks that arise from contact with other users.
11.6. Any further liability of Jobtero is excluded. Any disclaimer of Jobtero’s liability also applies to the personal liability of Jobtero’s legal representatives, executives, and employees.
11.7. If you believe that something on the platforms violates these terms, please report it using the reporting forms provided on the platforms, so that Jobtero can review the suspicion at its discretion and request the user to remove the content or remove the content itself. Jobtero is not liable to users for carrying out this activity.
12. Data Protection
12.1. Your privacy is important to us. Please read our Privacy Policy to learn how we collect, use, and protect your personal data.
12.2. All collection and processing of personal data are carried out in compliance with and consideration of applicable data protection laws.
13. Termination
13.1. The agreement between the platform user and Jobtero is concluded for an indefinite period. You can terminate your user account at any time and without giving any reason by using the corresponding functions on the platforms, accessing the help pages, or contacting us via email.
13.2. When the agreement between the user and Jobtero ends, customer data remains stored. Jobtero is legally obliged to retain certain data (e.g., customer data, order data, payment data) for a legally prescribed period. This data retention policy ensures that Jobtero complies with legal and regulatory obligations. Your data will be securely stored and protected during this period. After the retention period expires, the data will be deleted or anonymized according to applicable laws and regulations. Further information on the processing of personal data can be found in the Privacy Policy. Jobtero complies with all provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
13.3. Jobtero reserves the right to terminate your user account or block your access to the platforms if you violate these terms.
14. Governing Law and Jurisdiction
14.1. These terms of use are governed by Italian law. In the case of consumers within the meaning of Art. 6, Para. 2 of Regulation (EC) No. 593/2008, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law that would otherwise apply.
14.2. Individual provisions of the terms of use are void if they conflict with mandatory provisions unless otherwise stipulated by law. The invalidity of individual provisions of these terms of use does not affect the validity of the entire terms of use if the invalid provisions are replaced by mandatory provisions by law or are not substantial.
14.3. The place of jurisdiction for all disputes arising from or in connection with these terms of use is Bozen (BZ – South Tyrol – Italy).
14.4. These terms of use are written in German. In the case of discrepancies with the respective translations, the German version shall prevail.
15. Final Provisions
15.1. These terms of use constitute the entire agreement between you and Jobtero.
15.2. The General Terms and Conditions (“GTC”) apply to all contracts between Jobtero and the customer and regulate all details related to the provision of services between these parties. Jobtero is committed to its privacy policies.

15.4. We reserve the right to update and adapt these conditions to reflect current legal and social developments.
